The CLARITY Act isn't dead, it just moved the fight to September.
Most traders wrote this bill off after Senate leadership shelved it ahead of the August recess. That read was premature. Thune filed to advance the CLARITY Act on August 9, setting up a procedural floor vote when the Senate returns in mid-September. It still needs 60 votes, meaning every Republican plus several Democrats, so passage isn't guaranteed. But the fact that leadership is scheduling it at all signals real appetite to finish what's been over a year in the making.
Why it matters: this bill decides whether tokens fall under SEC or CFTC jurisdiction, a question that's driven nearly every major US crypto legal fight since 2017. Clarity here would likely unlock deeper institutional participation, particularly for infrastructure and RWA-linked names like $LINK, $ONDO, $ETH, and $SOL, since compliance uncertainty has been a real barrier to larger allocators.
If it stalls again, expect continued ad hoc regulation, keeping $XRP, $HYPE, $AAVE, $AVAX, and $SUI trading more on narrative than institutional flow. $BTC likely sees less direct benefit either way, given its commodity classification is less contested.
